Motor Vehicle Collisions
A vehicle accident can happen in the blink of an eye, but its effects can last much longer. All too often, victims injured in a car accident jump at the insurance company's first offer before understanding the extent of an injury and how it will affect their life. You are only permitted one insurance settlement and accepting one too soon often means the loss of full compensation.
At Thomas Law, we handle everything from cars and commercial trucks to motorcycle and pedestrian accidents, as well as accidents caused by drunk and distracted drivers. We will conduct a thorough investigation of what happened in order to prove that the other party was at fault. The full nature and extent of your injuries will be evaluated and we will seek to obtain you full compensation for those injuries. If you were injured by the negligence of another, some elements of compensation include: past and future medical bills, lost income or wages, loss of future earning potential, pain and suffering and loss of normal life- which is the inability to do the things you normally enjoy doing.
At Thomas Law, we will help you determine the full value of your motor vehicle collision claim and fight for all the compensation to which you are entitled. Again, not only will we fight for you, we will fight with you.
An unexpected death is always difficult to bear. When the accident was the result of negligent or wrongful conduct, the pain can be intolerable. A wrongful death lawsuit is meant to help a surviving spouse, son, daughter, parent or sibling obtain compensation to cover medical bills, lost income, funeral expenses and other damages. Placing a financial value on the life of a loved one is impossible, but the compensation can allow you to focus on the grieving process.
For these complex cases, you want an experienced attorney who will treat your family with compassion and work hard to recover compensation. Whether caused by a vehicle accident, medical malpractice or other accident, we can help.
At Thomas Law, we have worked with dozens of families providing compassionate representation. We will work to help you obtain justice and compensation for your loss, giving you the peace of mind to grieve with your family. Although nothing we can do will get back what you have lost, our representation will hold those responsible for the death of a loved one accountable.
Medical malpractice occurs when a health care provider violates the standard of care when providing treatment to a patient, causing the patient injury. Medical malpractice can result from an action taken by the medical professional or by the failure to take a medically appropriate action. Examples of medical malpractice include: misdiagnosis of, or failure to diagnose, a disease or medical condition; failure to provide appropriate treatment for a medical condition; or unreasonable delay in treating a diagnosed medical condition.
We trust doctors, nurses and other medical professionals with our lives. When that trust is violated, the results can be tragic. If you or someone in your family has suffered because of a doctor's malpractice, you and your family will face adversity. Some injuries force victims to contend with a lifetime of complications. Some, tragically, result in wrongful death.
At Thomas Law we have had the tough conversations regarding medical errors. Because medical malpractice deals with the human body, many times what some view as a medical error at first glance may just be a bad result. A bad result is not medical malpractice. At Thomas Law, we have sat in living rooms, dining rooms and kitchens in the Chicago area and outlined the requirements for filing a medical malpractice action in Illinois. We will consult with high quality doctors and other medical professionals to determine the merits of a case and then let you know our findings.
Illinois law allows those who suffer injury because of the condition of another person's business or home to bring what is known as a premises liability claim. These suits allow injured parties to collect damages against property owners and occupants who have been negligent in keeping up their property. When accidents happen, negligent property owners and occupants may be liable for medical bills, lost wages, pain and suffering and more.
Premises liability accidents include slip-and-fall accidents, dangerous property accidents, inadequate lighting, open hazards and dog bites. Injuries can include head injuries, back and spinal injuries and disfigurement.
It is important to remember that just because an accident or injury occurs on a piece of property does not make the owner of the property responsible for your injury. Generally, for an owner to be responsible for an injury, there must be a dangerous condition that caused the injury and that the owner failed to use reasonable care to remedy or warn of that condition.
At Thomas Law, we have represented clients involved in premises liability claims. We will fight for and obtain full compensation for your injuries. We will compassionately walk you through the process and strive to put you back in the same position as you were in before your injury. At Thomas Law, not only will we will fight for you, we will fight with you.
In Illinois, workers' compensation is a no-fault system of benefits paid by employers to workers who experience job-related injuries or diseases. In general, if you have to miss work because of a work related injury, you may be eligible to obtain total disability payments. Total disability payments are weekly payments that are equal to two-thirds (or 67%) of your weekly salary. You also are able to see a doctor of your choice. Your employer should pay all of the reasonable and necessary costs for medical treatment. Finally, you are eligible for permanent disability benefits. Permanent disability benefits are a settlement for your injury.
If you are an injured worker in Illinois, make sure that you know your legal rights.
At Thomas Law, we not only seek to maximize compensation for our clients who were injured at work, but we compassionately walk with them through the process, aiming to get our clients back to the same condition they were in before the injury. Unfortunately, in many cases there will be long term effects from work place injuries; in those, like all of our cases, we will fight to get maximum compensation.
